That viral Instagram post about tesana.ai might have you dreaming of easily creating your own games and earning big from them. The idea of an AI making game development accessible and profitable is exciting! But before you jump in, it’s crucial to understand the real-world implications, especially concerning who truly owns the ideas, assets, and games you generate, and what responsibilities you’re taking on. Let’s break down the Tesana.ai [en/terms] and Tesana.ai [en/privacy] to uncover what’s happening behind the scenes. Is tesana.ai safe for your creative freedom and potential earnings? Let’s find out.

Who Really Owns Your Game? Understanding IP Rights on Tesana.ai

The promise of creating your own games and making money is a powerful one, but the devil is often in the details of intellectual property (IP) ownership. Tesana.ai outlines specific conditions for who controls the content you create, especially differentiating between free and paid plans.

First, a critical point from the Tesana.ai [en/terms] is your responsibility for anything you upload or generate:

“you have all rights, permissions, and consents needed to provide the Submission and allow Tesana to use it to deliver the Service and generate Output your Submission and Tesana’s use of it (including generating Output) do not violate any law, contract, or third-party right Tesana does not need to obtain additional licenses or pay royalties to any third party because of Tesana’s use of your Submission to operate and maintain the Service”

This means you’re on the hook to ensure your “Submissions” (your content) are legally clear from the start. But what about the “Output” — the game or assets the AI generates based on your input?

Here’s where the plan you choose makes a huge difference, as stated in the Tesana.ai [en/terms]:

“On the free plan, you do not receive the ownership or assignment of generated Output described above; instead, you receive a personal, non-commercial license to use the games you create, and free games are published on Tesana with Tesana branding (which serves as attribution) and may not be sold, exported, or used to earn money.”

If you’re using the free plan, you do not own the generated content. You get a personal, non-commercial license, meaning you can’t sell or export your free games, and they’ll carry Tesana branding. This directly counters the “make money” hype for free users. While paid plans might offer more, the default for free users is clear: limited rights.

Furthermore, Tesana claims broad rights to use your content and the output. According to the Tesana.ai [en/terms], by using the service, you authorize Tesana to:

“provide and operate the Service (including generating Output, hosting your games, and powering publishing, play, export, and store features) maintain safety, security, and abuse prevention improve, develop, and enhance the Service and the Tesana game engine, including by reviewing and referencing generated Output (such as generated code and assets) market and promote the Service (for example sharing examples of public games)”

And even more significantly, the Tesana.ai [en/terms] also states:

“To operate and improve the Service, you authorize Tesana to extract, index, store, and reuse assets generated within your games (Output) and to surface them in other creators’ games.”

This means that components of your generated game, like specific assets, could potentially appear in other users’ games. It’s a fundamental part of how their AI system improves, but it does impact the uniqueness and exclusivity of your creations. Finally, a less common but important clause in the Tesana.ai [en/terms] notes that you:

“waive moral rights in your Content as against Tesana and those acting on our behalf.”

Waiving moral rights means you give up certain non-economic rights associated with your work, like the right to claim authorship or object to derogatory treatment of your work, as far as Tesana is concerned.

Tesana.ai’s Use of Your Content and AI Training

The AI at the heart of Tesana.ai thrives on data, and your creative output is a key part of that. Understanding how they collect and utilize your content, especially for AI development, is crucial.

Firstly, the Tesana.ai [en/privacy] states:

“We collect and store the content you provide and generate when building games, including: How we use this content, including for AI/ML development, is described in ‘Your Content and AI Development’ below.”

This makes it clear: the content you generate isn’t just for your game; it’s fed back into Tesana’s systems. The Tesana.ai [en/terms] elaborates on this, stating that Tesana has rights to “improve, develop, and enhance the Service and the Tesana game engine, including by reviewing and referencing generated Output (such as generated code and assets).” This means your games, code, and assets are directly contributing to the evolution of the Tesana AI itself.

Beyond direct AI training, parts of your creations can be reused. As noted earlier, the Tesana.ai [en/terms] grants them the right to “extract, index, store, and reuse assets generated within your games (Output) and to surface them in other creators’ games.” This isn’t just about training; it’s about potentially integrating elements from your work into others’ projects, which further blurs the lines of individual creative ownership, especially for free users.

The Shifting Sands: What Happens to Your Games and Earnings?

When a company reserves the right to make unilateral changes, it introduces a level of uncertainty about the long-term viability of your creations and any potential earnings. Tesana.ai includes several clauses that give them significant flexibility.

The Tesana.ai [en/terms] clearly states:

“We may change, suspend, or discontinue any part of the Service at any time.”

This broad right means that the platform, features, or even the underlying technology you rely on to make your games could be altered or removed without notice. If you’re building a business around Tesana.ai, this is a significant risk factor. This applies directly to monetization programs too. The Tesana.ai [en/terms] also says:

“We may modify, resume, or permanently discontinue the Creator Earnings Program at any time.”

So, even if you manage to earn money, the program that allows you to do so can change or disappear at any moment.

Beyond changes to the service or earnings programs, Tesana.ai also reserves the right to control access and content. They can “terminate accounts of repeat infringers” if you violate IP rights, and even “limit access for users who infringe others’ IP rights,” according to the Tesana.ai [en/terms]. Furthermore, they may “delete or remove Content from inactive accounts” and “limit or remove access to the free tier” if they “reasonably believe free-tier use is abusive or not in good faith.” Even if you’re just trying out the service, the Tesana.ai [en/terms] states:

“If you end the trial without subscribing, Content associated with the trial may become unavailable and may be deleted.”

This highlights the importance of understanding their terms around trials and continued subscriptions to avoid losing your work.

Your Responsibilities and Liabilities

While Tesana.ai provides the tools, the burden of responsibility for your content and actions rests heavily on your shoulders. The Tesana.ai [en/terms] outlines a comprehensive list of prohibited activities and responsibilities:

“submit, upload, transmit, or generate Content that infringes intellectual property, privacy, publicity, or other rights of others submit Content you do not have the legal right to use or share ... generate or share unlawful, harmful, threatening, harassing, abusive, defamatory, obscene, pornographic, excessively violent, hateful, discriminatory, or otherwise objectionable Content ... use the Service or Output to build, train, improve, or enable competing AI systems, models, products, or services, or to train other machine learning systems, except where Tesana expressly permits in writing”

This means you’re not only responsible for the legality and ethical nature of your direct submissions but also for how the AI-generated “Output” is used. For games you publish, the Tesana.ai [en/terms] states: “You are responsible for the games you publish and for ensuring they comply with these Terms.” This extends to third-party platforms, as “You are responsible for meeting each destination platform’s requirements and for complying with the license terms of any third-party or CC0 assets included in your game.”

Most significantly, if anything goes wrong due to your actions, you could be held financially accountable. The Tesana.ai [en/terms] includes a robust indemnification clause, stating you will “indemnify and hold Tesana haros” for claims arising from:

“your use of the Service your Submissions or Output, including publishing, sharing, selling, or commercializing them your violation of these Terms your violation of any law or third-party right”

This means if someone sues Tesana because of something you created, published, or did on the platform, you might have to cover their legal costs and damages.

Finally, be aware of how Tesana limits its own liability. They disclaim responsibility for user-generated content, stating in the Tesana.ai [en/terms]: “Tesana does not endorse user Content and is not responsible for user Content posted or shared through the Service.” They also limit liability for losses due to your failure to safeguard your account, as per the Tesana.ai [en/terms]: “We are not responsible for losses caused by your failure to safeguard your account.” This underscores the importance of strong passwords and account security on your part.
